This Warranty Policy ("Policy") describes the limited warranties, disclaimers, and customer responsibilities applicable to shipping containers sold or rented by USA Container Pros ("Company," "we," "our," or "us").
Unless otherwise stated in a written agreement signed by an authorized representative of USA Container Pros, this Policy governs all warranty matters.
1. General Warranty Statement
USA Container Pros carefully inspects containers before sale or delivery to help ensure they meet the condition grade represented at the time of purchase.
Unless expressly stated in writing, all containers are sold "AS IS, WHERE IS", subject only to any limited warranties specifically described in this Policy or required by applicable law.
2. Container Grades
Containers may be sold in one or more of the following industry-recognized grades:
One-Trip Containers
Generally considered the highest cosmetic grade available.
Typical characteristics include:

Minimal wear

Nearly new appearance
-
Minor handling marks from initial shipment
-
Functional doors and seals
-
Structurally sound construction
-
Minor cosmetic imperfections are normal and are not considered defects.
Cargo Worthy (CW)
Cargo Worthy containers generally meet standards suitable for international cargo transport at the time of inspection.
Typical characteristics may include:

Prior commercial use
-
Surface rust
-
Dents
-
Repaired areas
-
Cosmetic wear
-
These conditions are expected and do not affect the stated grade.
Wind & Water Tight (WWT)
Wind & Water Tight containers are generally intended to provide protection from normal weather conditions.
WWT containers typically have:

Functional doors

Working seals
-
No significant daylight visible through walls or roof during inspection

No active leaks at the time of inspection
-
WWT does not guarantee:
-
Waterproof performance under every weather condition

Protection after customer modifications
-
Resistance to future deterioration

As-Is Containers
Containers sold "As-Is" are offered without cosmetic guarantees and may contain defects, repairs, rust, dents, patches, or other conditions consistent with their age and prior use.
3. Cosmetic Conditions
The following are considered normal characteristics of used shipping containers and are not covered by warranty:

Dents

Weld repairs
-
Paint fading
-
Logos
-
Shipping labels
-
Floor discoloration

Minor floor repairs

Weathering

Previous markings

Manufacturing variations

4. Flooring
Container flooring may consist of treated hardwood or other commercially accepted materials.
Because many used containers have seen years of service, flooring may contain:

Stains

Filled repairs

Wear patterns
-
These conditions are normal unless specifically represented otherwise in writing.
5. Door Operation
Doors are inspected for reasonable operation prior to delivery.
Due to the weight and design of shipping container doors:

Some force may be required during operation.

Minor adjustment may be necessary after placement on uneven ground.

Door alignment may change if the container is placed on an unlevel foundation.
Door adjustments resulting from improper placement or site conditions are not covered.
6. Roof Condition
Roofs are inspected for significant structural defects and visible leaks at the time of inspection.
Normal roof characteristics may include:

Surface rust

Prior repairs

Customers should avoid walking on container roofs unless they have verified that it is safe to do so.
7. Customer Modifications
Any warranty or condition representation may become void if the container has been:

8. Improper Use
This Policy does not cover damage resulting from:

Unauthorized modifications

Chemical exposure

Neglect

9. Customer Responsibilities
The customer is responsible for:

Maintaining a level foundation

Routine maintenance

Periodic inspection

Protecting the container against corrosion

Proper ventilation
-
Compliance with local building codes

Any permits required for installation or use

10. Maintenance Recommendations
To maximize the life of the container, customers should:

Inspect roof seams periodically.

Remove standing water when practical.
-
Touch up damaged paint to reduce corrosion.
-
Lubricate door hinges and locking mechanisms.
-
Keep doors free of debris.
-
Maintain proper drainage around the container.

Address minor rust promptly.

11. Limitation of Warranty
Except for any written limited warranty expressly provided by USA Container Pros, the Company disclaims all implied warranties, including:

Merchantability

Fitness for a particular purpose

Non-infringement

To the fullest extent permitted by applicable law.
No employee, salesperson, or representative is authorized to modify this Policy unless the modification is made in writing and signed by an authorized officer of the Company.
12. Limitation of Liability
To the fullest extent permitted by law, USA Container Pros shall not be liable for:

Lost profits

Loss of use

Consequential damages

Incidental damages

Special damages

Indirect damages

The Company's maximum liability shall not exceed the purchase price actually paid for the applicable container, except where prohibited by law.

Photographs showing the claimed condition

USA Container Pros may inspect the container or request additional information before determining whether any remedy is available under this Policy.
14. Exclusive Remedy
If USA Container Pros determines that a warranty obligation applies, the Company may, at its discretion:

Repair the issue;

Replace the affected container (subject to inventory availability); or

Provide another remedy permitted under the applicable written agreement.

These remedies are exclusive and replace all other potential remedies to the extent permitted by law.

This Warranty Policy is governed by the laws of the State of Oklahoma.
